Terms of Sale

These terms apply to every order placed on kugaki.com. By placing an order you accept them and our End-Use Policy, which forms part of these terms.

1. Who can buy

We sell to institutions and businesses only. Each order needs a completed buyer verification and end-use declaration. An order is accepted only when we confirm it by email or ship it; we may refuse or cancel any order before then and refund any payment taken.

2. Products and use

All products are for laboratory use only (research, analytical, quality-control and teaching work in laboratory environments). They are not for drug, medicinal, household or any other use, including human or veterinary use, diagnosis, food, cosmetics or further manufacturing. Product images are representative; the packaging you receive may differ.

3. Specifications and documents

Each product is supplied to the specification for its grade. A Certificate of Analysis is supplied for each lot, and the Safety Data Sheet and technical data sheet are available on request. Information on the website is given in good faith for guidance; the buyer is responsible for deciding whether a product is suitable for its intended use.

4. Prices and payment

Prices are in US dollars and exclude import duties, local taxes and customs charges at the destination, which are the buyer's responsibility. We may correct obvious pricing errors before accepting an order. Payment is due when the order is placed unless we have agreed credit terms in writing.

5. Shipping, import and compliance

Products ship from India. The buyer is responsible for import permits, licences and customs clearance in the destination country, and for compliance with export-control and sanctions laws. Delivery dates are estimates. Risk passes to the buyer on delivery to the carrier, unless agreed otherwise.

6. Returns and claims

Tell us within 14 days of delivery if a product is damaged in transit or does not meet its specification, quoting the order and lot number. If we confirm the problem we will replace the product or refund its price. For safety reasons we do not accept returns of opened chemicals, or of products that are not damaged or out of specification.

7. Liability

To the extent the law allows, our total liability for any order is limited to the price paid for the products concerned, and we are not liable for indirect or consequential loss, loss of profit or loss of data. We are not liable for any loss arising from use of a product outside its stated use or in breach of the End-Use Policy. Nothing in these terms limits liability that cannot be limited by law.

8. Indemnity

The buyer will indemnify KUGAKI against claims, losses and costs arising from the buyer's breach of these terms or the End-Use Policy, including any misuse, resale or re-export of products, or any false information given in the buyer verification or end-use declaration.

9. Law

These terms are governed by the laws of India. The courts of India have jurisdiction over any dispute, without limiting any right we have to bring proceedings elsewhere.
